I find it amusing that some Democrats think that the primaries are required to be fair. The DNC is a national organization. It is allowed to set its own rules as it sees fit, just like your gym can require you to wipe down equipment after you use it. If the DNC decided that you had to be at least 5'10" to vote in their primary, then all the short democrats in the country would just have to deal with it. If the DNC decides that Florida got too uppity, and doesn't deserve to be counted, then so be it.
I agree that national elections must give fair weight to each state, and each state ought to allow fair weight be given to its citizens. However, the primaries are NOT national elections (check Article II of the constitution if you don't believe me.) The primaries are a way for members of a political party to voice their views to the leadership of said party as to which candidate might be the best choice to represent their party in the actual national elections. That's it. There are no legal requirements at the federal level that the Democratic primaries be "fair" to every state.
I see no logical reason for a lawsuit like this to succeed... but logic doesn't really enter into the law. If it did, millions of lawyers would be out of work. |
