Since there is now a supreme court ruling stating that there is an individual right to keep and bear arms, will violations of due process in regard to the Second Amendment be easier to attack now? Say, for instance, there is a law making it illegal to possess a firearm simply because of a restraining order. Since restraining orders can be obtained without a conviction of any kind... wouldn't rules about due process apply?
I know it isn't the most beautiful law to attack, and I certainly don't think it is a good place to start, but I can see it popping up in court before more attractive cases. |
