From the Heller opinion: Miller’s holding that the sorts of weapons protected are those "in common use at the time" finds support in the historical tradition of prohibiting the carrying of dangerous and unusual weapons.
Before the ruling, a lot of people bought evil black rifles "just in case". Before this election, people will continue to do so, pretty much for the same reason. Now, due to this wording in the Heller opinion, I'd suggest that you buy as many high-capacity-capable semi-auto firearms as possible, not in case there is a ban, but to prevent an "assault weapons" ban from being ruled constitutional. It would appear that the less "unusual" a certain type of firearm becomes, the more protected it is. |
