It looks like WVCDL is rolling up their sleeves. Charleston, the state capital, has laws on the books which are out of sync with the rest of the state. WVCDL, under the leadership of Jim Mullins, is looking to have them repealed. Currently, Charleston disallows legal carry, with a permit, of any weapon on certain parts of city property. The more onerous and controversial part of the city's gun ordinance requires a 3-day waiting period, and limits purchases to one handgun a month.
The laws have proven to be ineffective. I'm not positive, but I believe the city's gun laws pre-date the state preemption laws which read grandfather in old ordinances. This means that technically the laws would not be in violation of state preemption §8-12-5a.

The provisions of section five of this article notwithstanding, neither a municipality nor the governing body of any municipality may limit the right of any person to purchase, possess, transfer, own, carry, transport, sell or store any revolver, pistol, rifle or shotgun or any ammunition or ammunition components to be used therewith nor to so regulate the keeping of gunpowder so as to directly or indirectly prohibit the ownership of the ammunition.

Provided, That any municipal ordinance in place as of the effective date of this section shall be excepted from the provisions of this section ...
This is a good fight for WVCDL, and I wish them the best. I certainly hope any of my readers in West Virginia would consider donating money and/or time to this effort. |
