    More Stupid Florida Gun Laws Comment

    Florida has some damn stupid gun laws.

    Today's lesson, from Attorney John H. Gutmacher:
    under Florida Statute 870.044 ... you can’t have a firearm in a public place during the emergency – no matter what.


    So, er, yeah.

    Under Florida Statutes 14.021 and 252.36, the Governor can theoretically do just about anything in the event of an emergency... but he must spell it out specifically.

    On the other hand, a local "official" who declares a state of emergency causes automatic emergency measures to take effect. The statute requires that all sales, display for sales, and possession in a public place (except by law enforcement and military) of any firearms or ammunition be COMPLETELY SUSPENDED.

    There is no exception for self defense or law abiding holders of concealed weapons permits.

    The authority of a local official to declare an emergency is based on - get this - a significant breakdown of law and order. Looting. Violence. Riots. Ya know, the kind of times you'd REALLY want to have a gun for self defense.

    What a damn stupid law.

    So, what do you and I do to get this resolved?

    Seriously (I know, coming from my mouth that's crazy, but stick with me here for a second). How about you and I find out what it takes to get legislation put in place to override this stupidity. During times of emergency, as Katrina showed us, the police cannot be everywhere and disarming the law abiding does nothing to improve the safety of the community.

    If this is just a poorly written law, then let's work to get it written better. If it's just stupid law, then lets work to get rid of it.

    What do you say? Ready to actually do some real work?

    Hell yeah. I wonder what the chances of getting Marion Hammer involved. She's got the political clout to make things happen, and I can see this being a relatively straight-forward win for the NRA/USofF, especially since anti-confiscation legislation has been a huge success across the nation.

    But I'd be willing to pound some pavement. Between you and me, we have some contacts across Florida that can help get the word out. I'd be happy to pass out fliers at gun shows and such. I can't imagine getting a bill written is particularly difficult (the text would say something to the effect of "870.44 is repealed").

    The biggest hurdle, and the reason we may need the help of the established lobbying front, is getting a state legislator to put the bill into play.

    More thoughts? Anyone else out there have thoughts on approaching this problem?
