Another instance of self defense in Florida
In Florida, the same rules for self defense that apply when you are in your home are also extended to your conveyance (i.e. car.)
This looks to me like it was a justified and legal case of self defense. The man had a Concealed Weapon permit (although, if you keep a firearm in your glove box or otherwise inaccessible, you don't need one.) He was also in fear of his life, as one of the assailants had a knife and made threats. He also called the police immediately. Given the information in the article, it seems this man is a law abiding gun owner who legally defended his life.
The three things that are considered for determining if the shooting was justified are whether or not the bad guy(s) had all three of the following:
Opportunity - Does the bad guy have the opportunity to kill or seriously harm you? In this case, yes, they were right beside the man's truck.
Ability - Does the bad guy have the ability to kill you? A reasonable person would assume that two men, one armed, could kill or seriously harm one man.
Jeopardy - Is there an eminent threat of death or great bodily harm? A reasonable person would come to the conclusion that two men screaming racial slurs and coming at you with a knife would constitute a legitimate threat to your life.
I'll bet cases like this make Paul Helmke squirm. |
