Short Answer: The same exact laws apply at gun shows as everywhere else.
Long Answer: The Florida State Constitution requires a 3-day waiting period (not including weekends and holidays) for purchase, at retail, of any handgun, unless purchaser holds a Florida concealed weapon permit. The state's gun law preemption statute also allows counties to impose up to a 5 day waiting period for the purchase, at retail, of both handguns and long guns.
At a gun show, two types of gun sales occur.
The vast majority of sales are performed by licensed dealers. In fact, most small gun shops do the largest portion of their business at gun shows. Dealers are required to follow federal law (regarding background checks, etc.) and state law (regarding waiting periods, etc.) regardless of whether they are selling a gun at a gun show or in their shop. If you buy a gun at a gun show from a dealer, you still have to fill out a form 4473, and pass a NICS background check. You must also wait three days to receive a handgun, unless you are exempt from the waiting period.
The other type of sale is between two private individuals. There is no legal difference between private sales that occur at gun shows and private sales anywhere else. |
