Answer: The state government preempts the field of regulation of firearms, with only a few exceptions. Cities, Counties, and other municipal governments may not pass any ordinance regulating firearm "purchase, sale, transfer, taxation, manufacture, ownership, possession, and transportation". The only ordinance a county may enact with regard to firearms (both long guns and handguns) is enacting a waiting period of up to five days between purchasing (at retail) and taking possession of a firearm.
Pinellas county has a three day waiting period when purchasing a rifle or shotgun. If you have a valid Florida CWP, you are exempt from that waiting period. If you are not purchasing the firearm from a retail establishment, you are also exempt. Technically you are also exempt from the county ordinance (but not the state 3-day waiting period for handguns) if you can prove you already own another firearm, but I would not count on gun shops knowing that one.
So, read up on state and federal law so you know what you can or can't do with a rifle. Ordinances which counties still have on their books from before the preemption law was passed carry no weight of law. |
