This article at GLN got me thinking about something...
In general, I'm actually OK with the ACLU. I know that will strike a lot of people as heresy, but hear me out. Most people on the pro-2A side of the fence take the stance that "they are clearly hypocrites, and for that they cannot be forgiven." The thing is, they do good work elsewhere. Granted, they are wrong about the second amendment, but they have staunchly stood up for unpopular, or politically incorrect free speech for decades. Sure, they lie about supporting all of our constitutional rights... and sure, they are a bunch of liberal wankers... but you have to give them credit for the good things they do, and not just write them off for the good things they don't do. A lot of people will argue the ACLU takes things too far, but people say the same thing about the NRA all the time, and we support them when that happens.
Anyway...
I was thinking about DC v. Heller, and what it might mean to the ACLU. What if SCOTUS rules that the second amendment guarantees an individual right of law-abiding citizens to own a functional firearm (or even more specifically, a handgun)? I doubt the court will rule any more broadly than that, but it is an honest-to-god possibility.
The ACLU has historically said:We believe that the constitutional right to bear arms is primarily a collective one, intended mainly to protect the right of the states to maintain militias to assure their own freedom and security against the central government. They state for this reason, they claim to take a neutral stance on gun control. They see no constitutional barrier to "reasonable" regulation of firearm ownership.
If the Supreme Court upholds the DC circuit court, then the ACLU would have to come up with another reason for remaining anti-gun. Granted, I don't think, in the end, the courts will see a problem with some restrictions and regulations of gun ownership. So that doesn't mean the ACLU will have to take a stand one way or another. But it would be nice to at least see them have to reword their section about Gun Control. |
