Sebastian got me thinking about something... In NJ, they have been trying to ban some guns based on the size of the bore... as we have discussed, this will end up including antique muskets and other less-than-modern muzzle-loading firearms. My question is, with the "common use" test pretty much enshrined (first by Miller, now re-enforced by Heller), how it will be applied to things that are not now in common use, but once were? I would assume that they would be OK, but that could lead to some interesting arguments about the legality of restrictions on commonly owned/used pre-1934 firearms. Is there even anything interesting in the category of "old, previously 'common', and currently heavily restricted"? |
